i am facing a problem with a contract regarding extension of DOC
date of opening of tender 15-10-04
date of acceptence 28-3-05
doc 22-6-05
aggrement was not done by the contractor and started the work and on date 25-6-05 contractor has asked to extend the doc and my supervisor has forwarded the requsition with information that 35 % work has been completed.
what should be the course of action.
please reply.

My dear Kumaran,
First of all, I would like to request you to identify your self properly e.g. your full name ,designation while posting your message so that one can relate the person who is posting the message with the querry being asked .
I am not sure whether you have asked for a password for being alloted to you as member .In case you have not, kindly do it right now by sending e-mail to mail@iricen.gov.in.Once you are alloted a password,the system will automatically take care of your profile being shown every time you post a message after you have logged in properly.
Now coming to your quarry, instruction are clear on the subject that an unqualified acceptance of a tender constitutes a binding contract untill a formal agreement is constituted and in order to ensure this,the acceptance letters are so suitably worded (refer Para 1256 E).
Therfore,signing of agreement can be got done even now if the acceptance letter has been issued in your case in this manner.
After an agreement has been signed, next step could be to measure the work done during the period of completion and release payment for the work done during this period.
Then,you can take a decision on merits on the request of the contractor seeking extension of time period of completion and regularise the validity of contract so that balance work can be got completed through same agency or another at his risk and cost, if he has failed.
